AI + IP Brand Builder Stages

Whether you use AI is up to you, but where in the process of IP Brand building you use it, there are different things to consider.

This simple model breaks down the stages of IP Brand Building. This allows you to consider where and if to use AI in each stage. It works for both IP development of the products themselves and in the marketing process.

At the time of writing (January 2026) AI models that didn’t license their training data face legal uncertainty.

Most output from AI models are not protected by copyright because a substantial human component is required for work to benefit from copyright protection.

This model can also be used to consider if AI can automate data management such as metadata application and distribution channels.

Audience targeting may also be considered for AI automation if both data protection and bias is considered and addressed.

Finally, AI may be used in engagement with audiences around the IP. I anticipate development of new AI tools for managing infringements of IP and also that a number of IP Brands will create spaces for their audiences to create and play with their IP and AI in permitted ways to deepen brand engagement and keep fans close without infringing the IP.
